Samsung goes to court against Apple over patents in iPhone 5

The rumors became truth. Samsung has already filed a lawsuit against Apple, accusing it of breaking patents in producing the iPhone 5. The allegations are that the U.S. company violated six technologies registered by the South Koreans.


The case, however, is not so simple, and for several reasons. The first and most obvious one is the frequent fights between companies in various courts around the world. Ie: it is more a matter of attack and counter-attack that actually caused some damage to intellectual property. Another is the fact that two patents are "FRAND", ie used as "standard" for the category. In practice, they could be used on any device as long as following a few rules. The question, then, whether this is simply a problem of non-payment from Apple to Samsung or is opportunism of the Asian company trying to cause a stir even greater in this fierce rivalry.
Recently the South Koreans had to pay $ 1 billion (£ 2 billion) for the Americans after a jury confirmed that Samsung had infringed Apple's patents in the United States. With such history, strike back with a process that can even prevent sales of the new smartphone "enemy" seems to be an obvious strategy.

Samsung aims to create a good base for arguments, this time victorious courts. In addition to this process, experts said, the company can move to another lawsuit against Apple because of patent violations regarding the iPhone 5 LTE connectivity.

Apparently, another judicial war between the two giants of the mobile market is approaching. In the end, when a win, the other probably is already planning the next counterattack.
