Injunction prohibits selling Samsung Galaxy Tab in the United States

The legal battle between Apple and Samsung in the United States won a new episode on Tuesday night (26). A judge granted an injunction in favor of Apple immediately banning the sale of the Galaxy Tab 10.1 tablets throughout the American nation. As usual in this type of decision, the Korean giant can (and will) use to continue selling the product.


"While Samsung has the right to compete, can not do so unfairly by flooding the market with offenders [Apple's intellectual property]," the magistrate wrote in the decision. Apple showed particularly strong arguments about the design of Galaxy Tab Judge believes that this product in the original model with 10.1 "screen infringe patents of rival.

Samsung also is prohibited from importing the Galaxy Tab 10.1 "or other products that infringe the same patent that led Apple to court.

The original Galaxy Tab was released in the U.S. market in October 2010, according to GSM Arena site. Today Samsung has renewed a line of tablet called Galaxy Tab 2, which was not affected by the injunction. South Korea can proceed with the sales. The Galaxy Tab 2 "second generation" Ice Cream Sandwich and is on sale in Brazil since mid-June.

There is no doubt that Samsung would appeal the decision. Still, it was an important victory for Apple in trubunais.
